Elyakim Rubinstein was born in Israel in 1947. He served in the Israel Defense Forces and graduated cum laude from the Hebrew University in Jerusalem, with degrees in Hebrew Language and Arabic Literature and Language, Law and Contemporary Jewry. He interned with the Office of the State Attorney in the Tel Aviv District Court and in the Ministry of Defense. He worked in the office of the General (Legal) Counsel to the Ministry of Defense from 1973 to 1977, where he served as Deputy Legal Counsel and Legal Counsel to the Rehabilitation Division from 1976 to 1977. From 1977 to 1986, he worked in the Ministry of Foreign Affairs as Assistant to the Minister of Foreign Affairs and Deputy Director-General, Legal Advisor to the Ministry of Foreign Affairs, and Minister (Deputy Chief of Mission) in Washington, D.C., participating in the negotiations on the Egypt-Israel Peace Treaty at Camp David and Washington, and later negotiations on normalization and autonomy. Beginning in 1986, he served as Government Secretary for four governments, and in 1994, he was appointed Legal Counsel to the Ministry of Defense and Assistant to the Prime Minister. At the same time, he chaired the Israeli delegation to the bilateral negotiation with the Jordanian and Palestinians in Madrid and Washington of the Peace Treaty with Jordan and it's implementing agreements.

In 1995, he was appointed Judge on the Jerusalem District Court, where he served until 1997, when he was appointed Attorney General of Israel, serving through 2003, over the years, he participated also in negotiations with Lebanon and Syria, and was the first chairperson of the Israel Anti-Drug Authority and founding chairperson of the forum monitoring Anti-Semitism in the government of Israel. In 2004, he was appointed Justice of the Supreme Court of Israel. Justice Rubinstein chaired the Central Elections Committee between 2012 and 2013 and is the recipient of the Gabriel Peace Prize for his work on the Peace Treaty with Jordan.
